Terms of Service
These terms are an agreement between you and SellTorch ("SellTorch", "we", "us") for your use of the SellTorch mobile app, the SellTorch API and MCP server, and this website (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you use SellTorch on behalf of a business, you agree to these terms for that business too.
1. What SellTorch does
SellTorch helps resellers run their store: it keeps your listings, photos and notes, publishes listings to marketplaces you connect (such as eBay), syncs your orders and buyer conversations, drafts listings from your photos with AI, and offers an AI assistant that can read and act on your store data. You can also connect SellTorch to AI apps such as Claude or ChatGPT through our MCP server. Features may change over time.
2. Your account
- You must be at least 18 years old (or the age of majority where you live) and able to enter into a contract.
- Give accurate account information and keep your sign-in secure. You're responsible for everything done through your account, including by members you invite to your organizations and by apps you connect to it.
- If you own an organization, you decide who can access it and what their roles allow. Members' access is governed by the roles you set.
- Tell us right away at support@selltorch.com if you think your account has been accessed without permission.
3. Your content and your listings
You keep ownership of everything you put into SellTorch: photos, listing text, notes, files and messages ("your content"). You give us permission to store, process, copy and transmit your content only as needed to run the Service for you, for example to resize your photos, send your listings to the marketplaces you choose, and pass your requests to the AI services that power drafting and the assistant.
You are responsible for your listings and for what you sell. In particular, you must:
- have the right to sell each item and to use each photo and piece of text you upload;
- describe items honestly and accurately, including condition, authenticity and defects;
- follow each marketplace's rules, fees and policies, and all laws that apply to you, including consumer protection, tax, export and product safety laws;
- not list prohibited, counterfeit, stolen or recalled items.
4. AI features: review before you publish
SellTorch uses AI models to draft listings from photos, suggest item details, and power the assistant. AI output can be wrong, incomplete or misleading. It may misidentify an item, its brand, size, condition or value, or take an action you didn't intend. You must review AI-generated content before you publish it, and check what the assistant did on your behalf. You are responsible for anything you publish or send through SellTorch, whether you wrote it or AI drafted it. Prices or values suggested by AI are not appraisals.
5. Marketplaces and other third-party services
When you connect a marketplace (such as eBay) or an AI app (through MCP), you authorize SellTorch to access that account and act on it as you direct: publish, revise and end listings, and read orders, buyers' details and messages. Your use of each third-party service is governed by its own terms and policies, which you agree to follow. We don't control those services and aren't responsible for their availability, fees, decisions (such as removing a listing or suspending an account) or actions. A marketplace may change or limit its integration at any time, which may change what SellTorch can do with it.
Buyer information you receive through SellTorch (names, addresses, messages) may be used only to complete and support your sales, as the marketplace's rules allow.
6. Acceptable use
Don't use the Service to:
- break the law, infringe others' rights, or defraud, harass or spam anyone, including buyers;
- upload malware or content that is illegal, sexually exploitative, or hateful;
- access accounts, organizations or data you aren't authorized to access;
- probe, scan, overload or disrupt the Service, or get around its limits or security;
- reverse engineer the Service except where the law allows it;
- resell or provide the Service to others as your own product, or scrape it in bulk;
- use AI features to produce content that violates these terms or the policies of the AI providers we use.
7. Fees
SellTorch is currently provided without charge. If we introduce paid plans, we'll tell you the price and terms before you're charged, and you won't be charged without agreeing. Marketplace fees are between you and the marketplace.
8. Ending your account
You can stop using SellTorch at any time and delete your account in the app (Settings → Profile → Edit → Delete account). See the Privacy Policy for what deletion removes.
We may suspend or close your account, or remove content, if you break these terms, if your use creates risk or legal exposure for us or others, or if we're required to by law. Where reasonable, we'll tell you first and give you a chance to fix the problem or export your data. We may also discontinue the Service; if we do, we'll give you reasonable advance notice when we can.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the Service will be uninterrupted, error-free or secure, that syncing with marketplaces will be complete or timely, that AI output will be accurate, or that you'll make any sales. Keep your own records of anything important.
10. Limitation of liability
To the fullest extent allowed by law, SellTorch will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, sales, data or goodwill, arising from or related to the Service, even if we were told they were possible. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or US $50. Some jurisdictions don't allow these limits, so they may not fully apply to you.
11. Indemnity
You agree to defend and indemnify SellTorch against claims, losses and costs (including reasonable legal fees) arising from your content, your listings and sales, or your breach of these terms or of the law.
12. Governing law and disputes
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Before filing a claim, please contact us so we can try to resolve it informally. Any dispute that isn't resolved informally will be brought in the state or federal courts located in California, unless the law where you live gives you the right to bring it elsewhere.
13. Changes to these terms
We may update these terms. If a change is material, we'll let you know in the app or by email before it takes effect. If you keep using the Service after a change takes effect, you accept the updated terms. If you don't agree, stop using the Service and delete your account.
14. General
These terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is unenforceable, the rest stays in effect. If we don't enforce a term right away, we haven't waived it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of the Service.
